AGB (general terms and conditions)

The general terms and conditions (hereinafter referred to as “GTC”) of Bondos GmbH apply. Bondos Ltd apply to legal transactions concluded via the online shops www.mybondo.com, www.jomevo.com, www.bond-airone.com. The above-mentioned online shops are operated by Bondos GmbH. Bonderer.

Bondos GmbH reserves the right to change these General Terms and Conditions at any time. The version of these General Terms and Conditions valid at the time of the order is decisive and may not be changed unilaterally for this order. Conditions of the customer that conflict with or deviate from these General Terms and Conditions will not be recognized unless Bondos GmbH expressly agrees to their validity in writing.

The term “customer” refers to any natural or legal person who has a business relationship with Bondos GmbH.

The range of products and services offered in the online shop is aimed exclusively at customers residing or based in Switzerland or Liechtenstein.

Deliveries are made exclusively to addresses in Switzerland or Liechtenstein, unless another delivery address is individually agreed upon.

Offers are valid as long as the product can be found in the respective online shop and/or stocks last.

For all product orders with a minimum age of 18, the customer confirms compliance with these legal provisions with his order.

Bondos GmbH strives to keep its online shops innovative and up-to-date. We provide our services professionally and carefully in accordance with these General Terms and Conditions and other contractual provisions. Bondos GmbH strives to always offer its customers the latest products.

Price information

The sales prices shown in the online shop are in Swiss francs (CHF). The sales prices represent market prices. The sales price includes all taxes (in particular VAT) as well as any recycling fees and copyright fees. In addition, shipping costs may apply in accordance with our shipping conditions.

Bondo Ihn. Bonderer reserves the right to change the prices of the products and services offered at any time. The price in the online shop at the time of the order is decisive for the conclusion of the purchase contract.

Additional services for which a charge is required (e.g. splitting an order) will be listed separately on the invoice.

Product information, availability and warranty information

Bondos GmbH always strives to provide customers with the best possible information and explanation about the products and services offered. This information is sometimes obtained directly from the manufacturers or from experts or our ambassadors and is prepared in a clear and customer-friendly manner for the customer. All information on products, services, recommendations, warranty conditions and warranty periods published in the online shop or on printed materials is therefore provided without guarantee and is not to be understood as a guarantee. In particular, no liability can be accepted for the accuracy, completeness and timeliness of the information. Images of products in printed materials (flyers, catalogs, etc.) and in the online shop are for illustrative purposes and are non-binding. In addition, no liability is accepted for advertised products if they were sold on another platform to which the online shop links. In this case, the respective general terms and conditions of the respective shop always apply.

Bondos GmbH attaches great importance to carefully maintaining availability information and displaying it as correctly and accurately as possible. Many of the products offered come from manufacturers in Switzerland. However, delivery delays may occur due to production or delivery bottlenecks or due to incorrect inventory data. All information on delivery times is therefore non-binding and without guarantee and can change at any time and without prior notice. Delivery may also be completely impossible if a product can no longer be manufactured or delivered. In this case, delivery is excluded in accordance with the “Conclusion of contract” section of these General Terms and Conditions.

Conclusion of the contract

The products, services and prices published in Bondos GmbH. The order in the Bondos Ltd online shop is considered an offer (cost estimate). However, this offer (cost estimate) is always subject to the (resolutive) condition of impossibility of delivery or an incorrect price indication (on the part of the manufacturer or Bondos GmbH). This means that non-delivery may occur because items are no longer available. It may also be the case that we have not indicated the correct prices in the shop.

The contract is concluded as soon as the customer places his order via the online shop, by telephone, fax or email. For online orders, the customer is informed of the receipt of the order by an automatically generated order confirmation sent by email. Receipt of the automatically generated order confirmation does not constitute an assurance that the product is actually available or can be delivered. It merely shows the customer that the order has been received and that the contract has thus been concluded, which is subject to the resolutive condition of non-delivery.

If one of the above-mentioned (resolutive) conditions occurs, the contract will be terminated immediately and without the involvement of the parties. We will inform our customers immediately of the termination. If the goods have already been handed over, ownership automatically passes to Bondos GmbH. Bonderer and the customer are obliged to return the product (with reimbursement of the price paid by Bondos GmbH). If the goods have not yet been handed over, the customer is neither obliged to pay the purchase price nor to accept them. Due to such a termination of the contract, Bondos GmbH can. Bonderer is not obliged to deliver a replacement, but will always endeavour to do so.

Payment terms

The customer undertakes to use the payment options provided by Bondos GmbH for payment. Bonderer. The current payment options and fees for the payment method can be found in the shipping and payment conditions and are displayed in detail during the ordering process.

If you pay by credit card or another instant payment method, the charge will be made when you place your order.

Retention of title

Products delivered to the customer remain the property of Bondos GmbH until the purchase price has been paid in full. The customer automatically grants Bondos GmbH the right to have any retention of title entered in the retention of title register.

Late payment

If the customer fails to meet his payment obligations in whole or in part, he will be in default with all outstanding payments immediately and without notice. Bondos GmbH. reserves the right to suspend all deliveries. In addition, Bondos GmbH reserves the right to withdraw from the affected orders.

Bondos GmbH can revoke the “invoice” payment option at any time for customers who fall behind on payment or who become aware of other circumstances that reduce their creditworthiness. In this case, the customer can only place orders using the other available payment methods in accordance with our shipping and payment conditions.

Bondos GmbH may cancel or suspend an order if

(a) A customer is or appears to be not creditworthy

(b) has more than one outstanding reminder; or

Cancellation and termination of the contract

Orders placed by the customer with Bondos GmbH are binding in accordance with the “Conclusion of Contract” section of these terms and conditions. The customer is then obliged to accept the ordered service/products. Subsequent changes and cancellations are possible in certain cases, but are at the discretion of Bondos GmbH and may be subject to processing costs, which will be invoiced to the customer.

If the customer does not accept the products within two weeks despite an existing obligation to accept them, Bondos GmbH can withdraw from the contract and invoice the customer for the processing costs.

In the event of impossibility of delivery in accordance with the “Conclusion of Contract” section of these terms and conditions, the customer has the right to withdraw from the contract no earlier than four weeks after the agreed delivery date. In the event of cancellation due to non-delivery, Bondos GmbH is responsible. Bonderer will refund any amounts already paid in advance to the customer. If payment has not yet been made, the customer is released from the obligation to pay. Further claims due to delivery delays or non-delivery are excluded.

Exchange and return

Delivery

Delivered or picked up products must be checked immediately for correctness, completeness and integrity. If defects or damage (visible or invisible) occur, the customer must report them to Bondos GmbH. Bonderer immediately after discovery, but no later than within 7 calendar days of receipt of the delivery or acceptance of the products. In order to process the complaint further, the shipment must be left in the delivered condition and the product must not be used.

Return of goods from repair

If the customer wishes to return the goods to Bondos GmbH for repair, this will be done at the customer’s expense and risk to the specified return location. The products must be sent with all accessories, properly packaged and insured. A detailed description of the error or defect and a copy of the invoice must be enclosed with the return shipment.

The guarantee is only valid if only our fragrances are used. The use of other fragrance mixtures can cause damage to the device. We therefore reject any warranty claims in this case.

The two-year warranty period from the delivery date always applies. The invoice serves as a guarantee certificate.

In the event of a warranty claim, the manufacturer will generally repair the product, replace it with an equivalent product or pay compensation in the amount of the current value, but not more than the purchase price of the product. The decision in each case rests with the manufacturer.

Does the manufacturer’s warranty exceed the warranty granted by Bondos GmbH? In this case, the customer is obliged to contact the manufacturer directly. The customer acknowledges that the products are not manufactured by Bondos GmbH. Claims under the manufacturer’s warranty are granted exclusively by the manufacturer. The manufacturer is solely responsible for examining a warranty claim.

A guarantee can only be given if there are no reasons for exclusion, such as damage caused by improper handling or mechanical damage. This includes, for example, weather damage, moisture damage, damage caused by falls and impacts, excessive wear and tear and defects that are the result of interventions or modifications. Wear parts, batteries, rechargeable batteries, lamps, etc. are excluded from the guarantee or are subject to a shortened guarantee period.

The products marked as “test models” in the shop are demonstration products. This means that these products have already been used and tested. These products may have slight visual defects, which is why they are sold at a reduced price. These visual defects are excluded from the guarantee. The manufacturer’s usual guarantee conditions apply with regard to functionality and usability.

Warranty replacement or repair does not extend the original warranty period.

Otherwise, the statutory warranty provisions according to Art. 197 ff. apply. OR. The customer has a right to subsequent performance, but not to withdrawal or reduction.

Liability

Claims for damages arising from non-delivery, termination of contract, breach of contract, poor performance due to fault when concluding the contract and unlawful acts are completely excluded against Bondos GmbH. Bondos Ltd and against the vicarious agents of Bondos GmbH, unless there is intentional or grossly negligent action.

ATTENTION: Any liability for indirect damages, indirect damages and consequential damages resulting from the use, faulty performance or non-performance of the goods supplied by Bondos GmbH. Bonderer is excluded.

Data protection

The privacy policy is an integral part of these terms and conditions. By accepting these terms and conditions, the customer also agrees to the privacy policy. Customer data can be exchanged within Bondos GmbH Bondos Ltd .

Jurisdiction and applicable law

The place of jurisdiction is the registered office of Bondos GmbH, 7000 Chur GR. The contract is subject to Swiss substantive law.
